The Service is operated by XQUIZ LLC, a limited liability company organized under the laws of the State of Delaware, United States of America, located at 8 The Green, Ste B, Dover, DE 19901, USA.

The Service involves two different kinds of data, and our responsibilities differ for each:

• Customer account data (we are the controller). For information about our customers — the people and businesses who create an account and build funnels — we decide how and why the data is processed.
• End-user / lead data (we are a service provider). When someone responds to a funnel published by one of our customers, that customer decides what is collected and why. We process that data on the customer's behalf and under their instructions. If you are an end user, the customer who published the funnel is responsible for that data, and you should direct your privacy requests to them (see "End users and leads" below).

Information you provide as a customer. Account details such as your name, email address, password, language and timezone preferences, profile avatar, billing information, and any content you create (funnels, media, and settings) or messages you send us for support.

Billing information. Payments are processed by our payment provider, Stripe. We do not store your full card number; Stripe provides us with limited details (such as the card brand, last four digits, and subscription status) to manage your subscription.

Information collected automatically. When you use the Service we automatically collect technical and usage data, such as your IP address, device and browser type, pages viewed, actions taken, referring URLs, and similar log data. We use cookies and similar technologies (see "Cookies" below).

End-user data collected through funnels. When end users interact with a customer's published funnel, we collect the responses and information that the funnel is configured to collect (which may include name, email, phone number, quiz answers, and other inputs), along with technical data such as IP address, device information, and tracking identifiers, on the customer's behalf.

We use information to:

• provide, operate, maintain, and improve the Service;
• create and manage accounts, process payments, and administer subscriptions;
• provide customer support and respond to your requests;
• monitor, secure, and troubleshoot the Service, and prevent fraud and abuse;
• understand how the Service is used and analyze and improve performance;
• send you service-related and, where permitted, marketing communications; and
• comply with legal obligations and enforce our agreements.

End-user data collected through funnels is processed only to provide the Service to the relevant customer and as that customer instructs.

We and our providers use cookies and similar technologies (such as local storage and tracking pixels) to operate the Service, remember your preferences, measure usage, and support marketing. These include:

• Essential cookies, required for authentication, security, and core functionality;
• Analytics, to understand how the Service and published funnels are used; and
• Marketing and attribution, such as the Meta Pixel, UTMify, and Rewardful, to measure campaigns and referrals.

You can control cookies through your browser settings. Blocking some cookies may affect how the Service works.

We do not sell your personal information. We share information only as described below:

• Service providers (subprocessors). We use trusted third parties to run the Service, including Stripe (payments), Google (authentication and integrations), Vercel (hosting), Cloudflare (content delivery and images), Amazon Web Services (S3) (media storage), Sentry (error monitoring), ClickHouse (product analytics), and Meta, UTMify and Rewardful (marketing and attribution). They may process data only to provide services to us.
• Legal reasons. To comply with the law, respond to lawful requests, or protect the rights, property, and safety of XQuiz, our users, or others.
• Business transfers. In connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.

Customers can connect their funnels to third-party tools such as Google Sheets, ActiveCampaign, RD Station, and custom webhooks. When a customer enables an integration, data collected through their funnels is sent to the chosen tool at the customer's direction. Those tools are controlled by the customer and governed by the third party's own terms and privacy policy; we are not responsible for how they use the data.

We retain information for as long as your account is active or as needed to provide the Service, and thereafter as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. End-user data collected through funnels is retained according to the relevant customer's use of the Service; customers can delete leads and other data from their account.

We use administrative, technical, and organizational measures designed to protect information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

XQuiz is operated from the United States, and we and our providers may process and store information in the United States and other countries. By using the Service, you understand that your information may be transferred to and processed in countries that may have different data protection rules than your own.

Depending on where you live, you may have rights over your personal information, including the right to access, correct, delete, or receive a copy of it, and to opt out of certain uses. United States residents, including under the California Consumer Privacy Act (CCPA/CPRA) and the Delaware Personal Data Privacy Act, may have the right to:

• know and access the personal information we hold about them;
• request correction or deletion of that information;
• opt out of the "sale" or "sharing" of personal information and of targeted advertising; and
• not be discriminated against for exercising these rights.

We do not sell your personal information. To exercise any of these rights, email us at support@xquiz.com.br. We will verify and respond to your request as required by applicable law.

The Service is intended for business use by adults and is not directed to children. You must be at least 18 years old to use the Service, and it is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

If you responded to a funnel or quiz built with XQuiz, the customer who published it — not XQuiz — is responsible for that data and decides how it is used. To access, correct, or delete your data, or to ask questions about how it is used, please contact that customer directly. If you contact us, we will forward your request to the relevant customer where we are able to identify them.

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised policy.
