Terms of Service

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

• "Customer" means the person or entity that creates an account and uses the Service.
• "Funnel" means the interactive funnels, quizzes, and pages a Customer builds and publishes with the Service.
• "End User" means a person who interacts with or responds to a Customer's Funnel.
• "Customer Content" means the content, data, and materials a Customer creates, uploads, or collects through the Service.

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for business use and is not directed to children.

You are responsible for the information you provide when registering, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us promptly at support@xquiz.com.br of any unauthorized use of your account.

Free trial. The Service is offered with a 7-day free trial that requires a valid payment method. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged.

Billing and renewal. Paid plans are billed in advance on a recurring basis (for example, monthly) through our payment provider, Stripe. Subscriptions renew automatically for successive periods until cancelled. You can cancel at any time; cancellation stops future charges and takes effect at the end of the current billing period.

Price changes. We may change our prices. We will give you reasonable advance notice of any price change, and it will take effect on your next billing period.

Payments are non-refundable and we do not provide refunds or credits for partial periods. The 7-day free trial is provided so you can evaluate the Service before being charged. You may cancel at any time to prevent future charges. This section applies except where a refund is required by applicable law.

You agree not to use the Service to:

• violate any law or regulation, or infringe anyone's intellectual property or privacy rights;
• send spam or unsolicited messages, or engage in phishing, fraud, or deceptive practices;
• upload or distribute malware, or attempt to gain unauthorized access to the Service or its systems;
• collect sensitive data without a lawful basis, or process data in a way that violates applicable privacy laws; or
• interfere with, disrupt, or place undue load on the Service, or scrape or reverse engineer it.

You retain ownership of your Customer Content. You grant us a limited license to host, process, and display it solely to provide and improve the Service.

You are solely responsible for your Funnels and for the data you collect from End Users. As between you and XQuiz, you are the controller of End User data and are responsible for having a lawful basis to collect it, for providing any required notices and consents, and for complying with all applicable laws — including marketing, anti-spam (such as CAN-SPAM and the TCPA), and privacy laws.

The Service, including its software, design, and trademarks, is owned by XQuiz and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted.

The Service may integrate with third-party services (such as payment, analytics, and marketing tools, and integrations you enable). We are not responsible for third-party services, which are governed by their own terms and privacy policies, and are provided on an "as is" basis.

Our Privacy Policy explains how we collect, use, and share information. By using the Service, you acknowledge that information will be handled as described there.

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will meet your requirements.

To the maximum extent permitted by law, XQuiz and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

You agree to indemnify and hold harmless XQuiz and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your Customer Content or Funnels, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict-of-laws rules. You agree that any dispute relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except where prohibited by applicable law.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
